These Terms of Use ("Terms") govern your access to and use of the website at biomasscontrols.com (the "Site"), operated by Biomass Controls PBC ("Biomass Controls," "BMC," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms cover the public Site and the documents and materials we make available through it. They do not govern the KELV°N® platform, the Biogenic Refinery, or any equipment, software, or service we provide under a separate agreement — those are covered by the contracts and service terms that apply to them.
You may use the Site for lawful purposes and to learn about our technology, products, and projects. You agree not to:
Biomass Controls PBC, the Biomass Controls name and logo, "Biogenic Refinery," KELV°N®, and the other product names and marks on the Site are trademarks or registered service marks of Biomass Controls PBC or its affiliates. The Site and its content — text, graphics, images, data, and layout — are owned by Biomass Controls or its licensors and protected by intellectual-property laws.
We grant you a limited, personal, non-exclusive, non-transferable license to view and use the Site for your own informational purposes. No other license or right is granted. You may share links to our pages, and you may use materials we have expressly marked as downloadable or shareable for their intended purpose. You may not otherwise reproduce, distribute, modify, or create derivative works from the Site's content without our written permission.
If you send us general feedback, questions, comments, or suggestions about the Site that are not personal information and are not marked confidential, we may use them without restriction and without obligation to you, including to improve our products and services.
This does not apply to project information you submit through our inquiry process — feedstock data, operating details, and similar business information. We handle that information as described in our Privacy Policy, use it to respond to and scope your inquiry, and do not use it for marketing. If we have signed a non-disclosure agreement with you, that agreement governs.
Please do not send confidential or proprietary information through the Site outside of an inquiry, or any information you do not want handled under our Privacy Policy and any applicable NDA.
The Site may link to third-party websites, publications, or resources. We provide those links for convenience and do not control or endorse the linked material, and we are not responsible for its content, accuracy, or practices. Your use of any third-party site is subject to that site's own terms.
The Site and its content are provided "as is" and "as available." To the fullest extent permitted by law, Biomass Controls disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and any warranty regarding the accuracy, completeness, or reliability of the information on the Site.
Product information on the Site is general. It is not a specification, a performance guarantee, or an offer. Anything site-specific — feedstock acceptance, throughput, emissions, and carbon-related outcomes — depends on project review. The Site may contain typographical or technical inaccuracies, and we may change or update information at any time without notice.
To the fullest extent permitted by law, Biomass Controls and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, business interruption, or loss of data, arising out of or relating to your use of, or inability to use, the Site — even if we have been advised of the possibility of such damages.
We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms; the Effective date above shows when they last changed. Your continued use of the Site after a change means you accept the updated Terms.
These Terms are governed by the laws of the State of Connecticut, USA, without regard to its conflict-of-laws rules.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions stay in full force. Our failure to enforce any provision is not a waiver of it.
These Terms, together with our Privacy Policy and any other terms we post on the Site, are the entire agreement between you and Biomass Controls regarding your use of the Site.
